1. License. The software and any accompanying data whether on disk, in read only memory, or on any other media (RECORDSET SOLUTIONS) are licensed, not sold, to you by RECORDSET SOLUTIONS. YOU MAY OWN THE MEDIA ON WHICH THE RECORDSET SOLUTIONS SOFTWARE IS RECORDED BUT RECORDSET SOLUTIONS RETAINS TITLE TO THE SOFTWARE. The RECORDSET SOLUTIONS Software and any copies that this License authorises you to make are subject to this License.

2. Permitted Uses and Restrictions. This License allows you to install and use the RECORDSET SOLUTIONS Software on a single computer at a time. This License does not allow the RECORDSET SOLUTIONS Software to exist on more than one computer at a time. You may make one copy of the RECORDSET SOLUTIONS Software in machine-readable form for backup purposes only. The RECORDSET SOLUTIONS Software is provided AS IS and without warranty of any kind and RECORDSET SOLUTIONS and RECORDSET SOLUTIONS' licensor(s) (for the purposes of provisions 3 and 4

RECORDSET SOLUTIONS DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE RECORDSET SOLUTIONS SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE RECORDSET SOLUTIONS SOFTWARE WILL BE CORRECTED. FURTHERMORE, RECORDSET SOLUTIONS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE RECORDSET SOLUTIONS SOFTWARE OR RELATED DOCUMENTATION IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY RECORDSET SOLUTIONS OR A RECORDSET SOLUTIONS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY. SHOULD THE RECORDSET SOLUTIONS SOFTWARE PROVE DEFECTIVE, YOU (AND NOT RECORDSET SOLUTIONS OR A RECORDSET SOLUTIONS AUTHORIZED REPRESENTATIVE) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

5. Limitation of Liability. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL RECORDSET SOLUTIONS BE LIABLE FOR ANY INCIDENT AL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS LICENSE. In no event shall RECORDSET SOLUTIONS' total liability to you for all damages exceed the amount paid for this License to the RECORDSET SOLUTIONS Software.

6. This License shall be governed by the laws of England, UK. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this License shall continue in full force and effect.
